Chapter 7 Bankruptcy
Chapter 7 bankruptcy also known as liquidation bankruptcy is a way to get a fresh start while keeping most of your personal belongings. In order to qualify, one must meet the thresholds of a means test. The test takes a look at your income and living expenses against the amount of debt you owe. Most people are able to keep their homes and vehicles in a Chapter 7 while having their unsecured debts discharged. Before filing for bankruptcy, one should sit down with one of our bankruptcy attorneys to determine if their property can be protected under a Chapter 7 bankruptcy.
Chapter 13 Bankruptcy
If you don’t meet the criteria of the means test for Chapter 7, filing for Chapter 13 may be the best option for you. Chapter 13 is a debt reorganization plan. It requires the creation of a debt repayment plan for the creditors. An individual generally has three to five years to pay off their debts, with reduced payments. In return for making timely and monthly payments, the courts allow the person to keep his or her assets. An advantage is that some credit reporting agencies will remove all records of your Chapter 13 bankruptcy filings after 7 years as opposed to 10 years when filing for Chapter 7.
Chapter 11 Bankruptcy
Chapter 11 usually results in a reorganization of the business or personal assets and debts, but can also be used as a means of liquidation. We will work closely with you to determine your options and evaluate the objectives of your business. If you would like to continue operating the business, but need reorganization on your debts in order to achieve better financial success, Chapter 11 Bankruptcy may be the best option for you. If you pursue a Chapter 11 filing, we will navigate you through the process, and file the necessary paperwork to complete the process.
